As Schmitt saw it, the state, as the principal agent of secularization and the supreme accomplishment of occidental rationalism, was the core institution of the modern world, which lasted from the 16th to the end of the 19th century, when the assumptions and concepts of the jus publicum Europaeum and the Eurocentric epoch of world history began to decline. Asserting that "all significant concepts of the modern theory of the state are secularized theological concepts," Schmitt felt the need to address the question of what political form might replace the state. It was in this context that he wrote Roman Catholicism and Political Form, which presupposes an affinity not only between the Church and the state, but between Catholicism and political thinking. Once the state began to lose its monopoly of politics and, thereby, its legitimacy, Schmitt looked to the other side of the occidental equation--the Catholic Church--in search of a new form of the political. His argument proceeds from the assumption that there is a structural identity between "the metaphysical image of the world a particular age creates" and "the form of a political organization."

In the absence of ubiquitous, high-speed "broadband" Internet connections for residential and small-business customers, the demand for IT equipment and new Internet service applications may stagnate.
Broadband policy is controversial in large part because of the differences in the regulatory regimes faced by different types of carriers. Cable television companies face neither retail price regulation of their cable modem services nor any requirements to make their facilities available to competitors. Local telephone companies, on the other hand, face both retail price regulation for their DSL service and a requirement imposed by the 1996 Telecommunications Act that they "unbundle" their network facilities and lease them to rivals. Finally, new entrants are largely unregulated, but many rely on facilities leased from the incumbent telephone companies at regulated rates to connect to their customers. This asymmetric regulation is the focus of this volume, in which telecommunications scholars address the public policy issues that have arisen over the deployment of new high-speed telecommunications services.

Should intellectual property be thought of as a form of regulation? Why did the movement for greater protection of intellectual property coincide with the deregulation movement?
Landes and Posner apply public-choice theory to the growth and character of intellectual property protection over the last half-century. The authors argue that public-choice theory alone cannot explain the coincidence of the deregulation movement and the rapid growth of intellectual property protection. Political forces and ideological currents associated with the deregulation movement, combined with interest-group pressures, best explain the increases in intellectual property protection since 1976.
The authors urge caution in equating intellectual property rights to physical property rights. They counsel skeptics of government to hesitate before extending a presumption of efficiency to a process by which government grants rights to exclude competition.
