Book Description:
Forensic mental health assessments are evaluations conducted by individuals from different disciplines on a variety of questions in civil, criminal, and family law. A growing number of mental health professionals, including psychologists, psychiatrists, and social workers, are being called upon to assess everything from an individual's competence to stand trial to the risk or threat of future violence, and asked to weigh in on cases ranging from murder and assault to malpractice and child custody." General principles have emerged to guide professionals conducting forensic mental health assessment. Forensic Mental Health Assessment: A Casebook illustrates those principles using relevant, real-world case material. Built around actual case reports from expert forensic psychologists and psychiatrists, the volume probes a broad range of legal questions through the detailed examination of more than 40 cases. Topics include Miranda rights waiver, competence to act as one's own attorney, competence to stand trial, juvenile commitment, sanity at the time of the offense, child custody, termination of parental rights, guardianship, and malpractice. This is the first casebook focusing specifically on forensic assessment. It contains cases from a broad range of civil, criminal, and family legal questions, described in case reports contributed by expert forensic psychologists and psychiatrists. * ISBN-13: 978-0387252261
* Format: PDF
* Size: 4.90 MB
Book Description:
Forensic psychologists and psychiatrists are increasingly asked to provide expertise to courts and attorneys in the criminal justice system. To do so effectively, they must stay abreast of important advances in the understanding of legal standards as well as new developments in sophisticated measures and the methods for their assessment. Fundamentals of Forensic Practice is designed to address the critical issues that are faced by mental health experts in their role of conducting assessments, presenting findings, and preparing for challenges to admissibility and credibility.
Uniquely practical and comprehensive, this volume operationalizes legal standards and describes empirically validated methods for their evaluation. Not only is this essential for mental health professionals, but it is equally valuable to criminal attorneys. Lawyers require both clinical knowledge and understanding of legal standards in order to prepare their own experts and to challenge those on the opposing side. For both clinical and legal experts Fundamentals of Forensic Practice offers a full view of all phases of criminal proceedings:
- Pretrial—diversion, determinations of bail, waivers of Miranda rights, and the capacity to consent to searches.
- Trial—competency to stand rial and criminal responsibility. Beyond insanity, the latter addresses mens rea, automatism, and psychological context evidence, such as battered-woman syndrome.
- Post-trial—sentencing, capital sentencing, competency to be executed, and other post-conviction issues.
Other key features include:
- Chapters on specific criminal issues in a consistent format, with comprehensive coverage of legal standards and relevant clinical methods
- Guidelines for conducting more effective forensic evaluations
- In-depth coverage of specialized assessments, eg. malingering, sexual predator cases, and the insanity defense.
- A detailed overview of direct and cross-examination strategies
This book is the second collaboration between Rogers and Shuman. As individual authors, each received the American Psychiatric Association’s prestigious Guttmacher Award for their outstanding contributions to forensic psychiatry.

Book Description:
Digital evidence--evidence that is stored on or transmitted by computers--can play a major role in a wide range of crimes, including homicide, rape, abduction, child abuse, solicitation of minors, child pornography, stalking, harassment, fraud, theft, drug trafficking, computer intrusions, espionage, and terrorism.
Though an increasing number of criminals are using computers and computer networks, few investigators are well-versed in the evidentiary, technical, and legal issues related to digital evidence. As a result, digital evidence is often overlooked,
collected incorrectly, and analyzed ineffectively. The aim of this hands-on resource is to educate students and professionals in the law enforcement, forensic science, computer security, and legal communities about digital evidence and computer crime.
This work explains how computers and networks function, how they can be involved in crimes, and how they can be used as a source of evidence. As well as gaining a practical understanding of how computers and networks function and how they can be used as evidence of a crime, readers will learn about relevant legal issues and will be introduced to deductive criminal profiling, a systematic approach to focusing an investigation and understanding criminal motivations.
Readers will receive access to the author's accompanying Web site which contains simulated cases that integrate many of the topics covered in the text. Frequently updated, these cases teaching individuals about:
* Components of computer networks
* Use of computer networks in an investigation
* Abuse of computer networks
* Privacy and security issues on computer networks
* The law as it applies to computer networks
* Provides a thorough explanation of how computers and networks function, how they can be involved in crimes, and how they can be used as a source of evidence
* Offers readers information about relevant legal issues
* Features coverage of the abuse of computer networks and privacy and security issues on computer networks
* Free unlimited access to author's Web site which includes numerous and frequently updated case examples

Use of argumentation methods applied to legal reasoning is a relatively new field of study. Many vitally important problems of legal reasoning can be profitably studied in light of these new methods, even if they cannot all be solved in any single monograph. This book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. New tools for analyzing these kinds of evidence are introduced, like argument diagramming, abductive reasoning, an analysis of conditional relevance and a new dialectical model of explanation.

Law and Politics: A Dilemma for Contemporary Legal Theory

Book Description:
Politics and the political discourse occupy a central position in the modern legal theoretical discussion. The goal of this book is to reconstruct and to classify, according to ideal-typical models, the different positions taken by the major contemporary legal theories as to whether and how law relates to politics. In particular, attention is focused on Kelsen, Hart, Finnis, Critical Legal Studies, Law and Economics and legal realisms. Though reaching different conclusions, these major legal theories have some common points of departure as to the "law and politics" issue: law and politics tend to keep the features of being two different phenomena as well as of presenting regions of interaction, although with differences as to extent and intensity. Finally, a possible explanation is presented as to why such different legal theories, though often reaching diametric results, somehow must still begin from these common basic points. The explanation for this is found in the specific character of law in the modern state, and the welfare state in particular.
