Accounting For Rape: Psychology, Feminism and Discourse Analysis (Women and Psychology)

By I. Anderson

Publisher: Routledge
Number Of Pages: 176
Publication Date: 2008-01-28
ISBN-10 / ASIN: 0415211735
ISBN-13 / EAN: 9780415211734
Binding: Hardcover

Book Description:

Accounting for Rape presents an original perspective on the subject of rape and sexual violence. The authors scrutinize existing social psychological experimental research on rape, in particular rape perception research, which, they argue, fails to analyse the subtlety and political significance of rape supportive reasoning and the forms that it takes, thus also underestimating the extent of rape supportive reasoning. The authors provide a critical interrogation of dominant theories and methodologies, and thought-provoking analyses of conversational data, exploring everyday accounting practices in relation to reports of both female and male rape. They synthesize discursive psychology and a feminist standpoint to explore precisely how rape and rape victimhood are defined in ways that reflect the social, political and cultural conditions of society.
They show how the gender and sexual orientation of alleged victims and perpetrators is crucial to social participants when making sense of a rape report and in apportioning blame and sympathy. They also examine how arguments that are critical of alleged victims are built in ways that are 'face saving' for the participants in the conversations, and how victim-blaming arguments are presented as 'common sense'. Crucial to this is the way in which rape supportive talk is underpinned by a range of deeply ingrained cultural sense-making resources that construct and legitimate hegemonic forms of heterosexual identities and gender relations and neo-liberal notions of ideal citizenship. Finally, the authors demonstrate the potential of the application for their approach in both professional and academic contexts to promote attitude change.
The book will be of great interest to those studying social and clinical psychology, cultural studies, sociology, women's studies and communication studies.

Values in Medicine: The Realities of Clinical Practice
(Biomedical Law and Ethics Library)

By Donald Evans

Publisher: Routledge Cavendish
Number Of Pages: 216
Publication Date: 2007-12-25
ISBN-10 / ASIN: 0415424690
ISBN-13 / EAN: 9780415424691
Binding: Paperback

Book Description:

Written by a leading proponent of the philosophy and ethics of healthcare, this volume is filled with thought-provoking and frequently controversial ideas and arguments. Accessibly written, it provides readers with a timely contribution to the current literature on medical ethics, in which the concept of subjectivity is a key issue characterizing current medical humanities.

Examining the critical assumption that scientifically-demonstrable facts will remove all uncertainty, the author argues that ethical dimensions of clinical practice do not always arise from undisputed facts, but that they are sometimes to be found at the level of the determinations of the facts themselves.

Firmly placing the patient back on centre stage, without underestimating the crucial role which science plays in modern medicine, this volume is an excellent account of ethics and science in healthcare and their proper place in assessing and meeting peoples health needs.

Equal Justice in the Balance: America's Legal Responses to the Emerging Terrorist Threat

by Raneta Lawson Mack, Michael J. Kelly

Publisher:University of Michigan Press
Number Of Pages:320
Publication Date:2004-04-19
Sales Rank:1508722
ISBN / ASIN:0472113941
EAN:9780472113941
Binding:Hardcover

Book Description:

"We are in difficult times for the protection of our liberties. Nonetheless, citizens are showing an increased willingness to resist the erosion of the U.S. Constitution. . . . Lawson Mack and Kelly stress the importance of not giving up these fundamental rights and conclude with a message of optimism, noting an increased backlash against the administration's more draconian measures. Although the landscape is still quite bleak, change is in the air."
-Michael Ratner, President, Center for Constitutional Rights, from the foreword

"A compelling and sophisticated critique of the U.S. government's post-9/11 actions. Mack and Kelly set the stage with the historical perspective on America's response to terrorism and the assessment of terrorist threats, before launching into a comprehensive analysis of the USA Patriot Act. Their hard-hitting approach and easy-to-read style makes for a fascinating treatment of the government's legislative and executive response to the attacks."
-Michael P. Scharf, Case Western Reserve University School of Law

With its sweeping critique of the USA Patriot Act and the Bush administration's maneuvers in pursuit of terrorists, Equal Justice in the Balance is a sobering and exacting look at American legal responses to terrorism, both before and after 9/11.

The authors detail wide-ranging and persuasive evidence that American antiterrorism legislation has led to serious infringements of our civil rights. They show us how deviations from our fundamental principles of fairness and justice in times of heightened national anxiety-whether the Red Scare, World War II, or the War on Terrorism-have resulted in overreaction and excess, later requiring apologies and reparations to those victimized by a paranoia-driven justice system.

While terrorist attacks-especially on a large scale and on American soil-damage our national pride and sense of security, the authors offer powerful arguments for why we must allow our judicial infrastructure, imperfect as it is, to respond without undue interference from the politics of anger and vengeance.

Murder in Tombstone: The Forgotten Trial of Wyatt Earp (The Lamar Series in Western History)

By Steven Lubet

Publisher:Yale University Press
Number Of Pages:276
Publication Date:2004-09-10
ISBN-10 / ASIN:030010426X
ISBN-13 / EAN:9780300104264
Binding:Hardcover

Book Description:

The gunfight at the OK Corral occupies a unique place in American history. Although the event itself lasted less than a minute, it became the basis for countless stories about the Wild West. At the time of the gunfight, however, Wyatt Earp was not universally acclaimed as a hero. Among the people who knew him best in Tombstone, Arizona, many considered him a renegade and murderer.

This book tells the nearly unknown story of the prosecution of Wyatt Earp, his brothers, and Doc Holiday following the famous gunfight. To the prosecutors, the Earps and Holiday were wanton killers. According to the defense, the Earps were steadfast heroes—willing to risk their lives on the mean streets of Tombstone for the sake of order.

The case against the Earps, with its dueling narratives of brutality and justification, played out themes of betrayal, revenge, and even adultery. Attorney Thomas Fitch, one of the era’s finest advocates, ultimately managed—against considerable odds—to save Earp from the gallows. But the case could easily have ended in a conviction, and Wyatt Earp would have been hanged or imprisoned, not celebrated as an American icon.

Which Rights Should Be Universal?

by William Talbott

Studio:Oxford University Press, USA

Book Description:

"We hold these truths to be self-evident..." So begins the U.S. Declaration of Independence. What follows those words is a ringing endorsement of universal rights, but it is far from self-evident. Why did the authors claim that it was? William Talbott suggests that they were trapped by a presupposition of Enlightenment philosophy: That there was only one way to rationally justify universal truths, by proving them from self-evident premises. With the benefit of hindsight, it is clear that the authors of the U.S. Declaration had no infallible source of moral truth. For example, many of the authors of the Declaration of Independence endorsed slavery. The wrongness of slavery was not self-evident; it was a moral discovery. In this book, William Talbott builds on the work of John Rawls, Jurgen Habermas, J.S. Mill, Amartya Sen, and Henry Shue to explain how, over the course of history, human beings have learned how to adopt a distinctively moral point of view from which it is possible to make universal, though not infallible, judgments of right and wrong. He explains how this distinctively moral point of view has led to the discovery of the moral importance of nine basic rights. Undoubtedly, the most controversial issue raised by the claim of universal rights is the issue of moral relativism. How can the advocate of universal rights avoid being a moral imperialist? In this book, Talbott shows how to defend basic individual rights from a universal moral point of view that is neither imperialistic nor relativistic. Talbott avoids moral imperialism by insisting that all of us, himself included, have moral blindspots and that we usually depend on others to help us to identify those blindspots. Talbott's book speaks to not only debates on human rights but to broader issues of moral and cultural relativism, and will interest a broad range of readers.

Real World Justice: Grounds, Principles, Human Rights, and Social Institutions (Studies in Global Justice)

Book Description:

The concept of global justice makes visible how we citizens of affluent countries are potentially implicated in the horrors so many must endure in the so-called less developed countries.

Distinct conceptions of global justice differ in their specific criteria of global justice. However, they agree that the touchstone is how well our global institutional order is doing, compared to its feasible alternatives, in regard to the fundamental human interests that matter from a moral point of view.

We are responsible for global regimes such as the global trading system and the rules governing military interventions. These institutional arrangements affect human beings worldwide, for instance by shaping the options and incentives of governments and corporations. Alternative paths of globalization would have differed in how much violence, oppression, and extreme poverty they engender. And global institutional reforms could greatly enhance human rights fullfillment in the future.

The importance of this global justice approach reaches well beyond philosophy. It helps ordinary citizens evaluate their options and their responsibility for global institutional factors, and it challenges social scientists to address the causes of poverty and hunger that act across borders.

The present volume addresses four main topics regarding global justice: The normative grounds for claims regarding the global institutional order, the substantive normative principles for a legitimate global order, the roles of legal human rights standards, and some institutional arrangements that may make the present world order less unjust.

All royalties from this book have been assigned to Oxfam.

The book's focus later turns to dialogues between a citizen's moral autonomy and political obligation in democratic Athens.

Book Description:
What duty do we have to stop others from doing wrong? The question is intelligible in almost any culture, but few seek to answer it in a rigorous fashion. The most striking exception is found in the Islamic tradition where "commanding right and forbidding wrong" is a central moral tenet. Michael Cook's comprehensive and compelling analysis represents the first sustained attempt to chart the history of Islamic reflection on this obligation and to explain its relevance for politics and ideology in the contemporary Islamic world.
