Description How and why do institutions change? Institutions, understood as rules of behaviour constraining and facilitating social interaction, are subject to different forms and processes of change. A change may be designed intentionally on a large scale and then be followed by a period of only incremental adjustments to new conditions. But institutions may also emerge as informal rules, persist for a long time and only be formalized later. Why? The causes, processes and outcomes of institutional change raise a number of conceptual, theoretical and empirical questions. While we know a lot about the creation of institutions, relatively little research has been conducted about their transformation once they have been put into place. Attention has focused on politically salient events of change, such as the Intergovernmental Conferences of Treaty reform. In focussing on such grand events, we overlook inconspicuous changes of European institutional rules that are occurring on a daily basis. Thus, the European Parliament has gradually acquired a right of investing individual Commissioners. This has never been an issue in the negotiations of formal treaty revisions. Or, the decision-making rule(s) under which the European Parliament participates in the legislative process have drastically changed over the last decades starting from a modest consultation ending up with codecision. The book discusses various theories accounting for long-term institutional change and explores them on the basis of five important institutional rules in the European Union. It proposes typical sequences of long-term institutional change and their theorization which hold for other contexts as well, if the number of actors and their goals are clearly defined, and interaction takes place under the "shadow of the future."

This book was handed to my by the religious leader of my church after a discussion regarding my son's legal problems.

In this book Zehr takes issue with the current system, which many claim is based on the Old Testament of the Bible. He views the criminal justice system as one which has been built on retributive justice. This system is built on retribution, the "eye for an eye" viewpoint. Zehr raises several substantial questions:

Is the retribution system working as a deterrent to crime?
Is the retribution system truly in line with the ideas of the Bible -- both Old and New Testaments?
Does the retribution system really help the victim?
Does "punishment" really rehabilitate the offender?

Moving forward Zehr then talks about a restorative system of justice. This system of justice is more akin to our civil courts than our criminal courts. Rather than being a crime against the state, the action of the offender is regarded as a crime against a person. Both victim and offender see each other. If done well, both victim and offender come to know each other as people, not just faceless stereotypes. This step alone can make a huge difference. For the victim, it's a chance to express his or her sense of violation. For the offender, it's a chance to understand that he or she hurt a person, not just the owner of a house that he or she ripped off.

Zehr realizes that he is wrestling with a utopian ideal. Restorative justice is far easier for us to accord to those who have done crimes such as burglary (unless you have been a victim of one and understand how violating the event can be). But what about the more brutal crimes of rape, child molestation or murder? Zehr believes the system needs substantial revamping in these ways as well, but acknowledges it is a much more difficult solution.

Summary: An excellent book

I have just finished reading Stanley Brodsky's Coping With Cross Examination. I absorbed it like a sponge. Although most of the book is devoted to testimony by mental health experts in criminal court, there is much in the book that is very relevant in other contexts. I have rarely been asked or required to testify in criminal cases, but I have provided expert medical testimony at hundreds of Social Security disability appeals hearings, complete with judge and lawyer. In that role there is often conflicting evidence and the expert must integrate all of the relevant evidence, and most importantly be prepared, professional, impartial, and provide relevant understandable testimony. Dr Brodsky's book clearly speaks to those points. The book is full of good examples, good humor, and good reasoning. It is the kind of book that I am likely to consult again to help me in my work. I highly recommend this book to any mental health professional who may be asked to provide sworn testimony. I also recommend it to those who may not testify but who may be retained by lawyers for evaluations or consultations. Dr. Brodsky's ethics are superb. This book is a very practical and helpful guide to working with lawyers and judges.
