Cicero the Advocate
By Jonathan Powell, Jeremy Paterson

--------------------------------------------------------------------------------

Publisher:  Oxford University Press, USA
Number Of Pages:  460
Publication Date:  2004-09-30
ISBN-10 / ASIN:  0198152809
ISBN-13 / EAN:  9780198152804
Binding:  Hardcover

--------------------------------------------------------------------------------

Product Description:

This is the first book in English to take Cicero's forensic speeches seriously as acts of advocacy, i.e. as designed to ensure that the person he represents is acquitted or that the person he is prosecuting is found guilty. It seeks to set the speeches within the context of the court system of the Late Roman Republic and to explore in detail the strategies available to Roman advocates to win the votes of jurors. The volume comprises a substantial introduction, fourteen chapters by prominent Ciceronian scholars in Britain, North America, and Germany, and a final chapter by a current British Appeal Court judge who comments on Cicero's techniques from the point of view of a modern advocate. The introduction deals with issues concerning the general nature of advocacy, the Roman court system as compared with other ancient and modern systems, the Roman "profession" of advocacy and its etiquette, the place of advocacy in Cicero's career, the ancient theory of rhetoric and argument as applied to courtroom advocacy, and the relationship between the published texts of the speeches as we have them and the speeches actually delivered in court. The first eight chapters discuss general themes: legal procedure in Cicero's time, Cicero's Italian clients, Cicero's methods of setting out or alluding to the facts of a case, his use of legal arguments, arguments from character, invective, self-reference, and emotional appeal, the last of these especially in the concluding sections of his speeches. Chapters 9-14 examine a range of particular speeches as case studies--In Verrem II.1 (from Cicero's only major extant prosecution case), Pro Archia, De Domo Sua, Pro Caecina, Pro Cluentio, Pro Ligario. These speeches cover the period of the height of Cicero's career, from 70 BC, when Cicero became acknowledged as the leading Roman advocate, to 49 BC when Caesar's dictatorship required Cicero to adapt his well-tried forensic techniques to drastically new circumstances, and they contain arguments on a wide range of subject-matter, including provincial maladministration, usurpation of citizenship rights, violent dispossession, the religious law relating to the consecration of property, poisoning, bribery, and political offences. Other speeches, including all the better-known ones, are used as illustrative examples in the introduction and in the more general chapters. An appendix lists all Cicero's known appearances as an advocate.

Orthodoxy and the Courts in Late Antiquity
By Caroline Humfress

--------------------------------------------------------------------------------

Publisher:  Oxford University Press, USA
Number Of Pages:  340
Publication Date:  2007-12-20
ISBN-10 / ASIN:  0198208413
ISBN-13 / EAN:  9780198208419
Binding:  Hardcover

--------------------------------------------------------------------------------

Product Description:

This book approaches the subject of late Roman law from the perspective of legal practice revealed in courtroom processes, as well as more "informal" types of dispute settlement. From at least the early fourth century, leading bishops, ecclesiastics, and Christian polemicists participated in a vibrant culture of forensic argument, with far-reaching effects on theological debate, the development of ecclesiastical authority, and the elaboration of early "Canon law." One of the most innovative aspects of late Roman law was the creation and application of new legal categories used in the prosecution of "heretics." Leading Christian polemicists not only used techniques of argument learnt in the late Roman rhetorical schools to help position the Church within the structure of Empire, but also used those techniques in cases involving accusations against "heretics" -- thus defining and developing the concept of Christian orthodoxy itself.

Legitimacy and Law in the Roman World: Tabulae in Roman Belief and Practice
By Elizabeth A. Meyer

--------------------------------------------------------------------------------

Publisher:  Cambridge University Press
Number Of Pages:  370
Publication Date:  2004-03-08
ISBN-10 / ASIN:  0521497019
ISBN-13 / EAN:  9780521497015
Binding:  Hardcover

--------------------------------------------------------------------------------

Product Description:

The Romans wrote solemn religious, public, and legal documents on wooden tablets often coated with wax. This book investigates the historical significance of this resonant form of writing and its power to make documents efficacious. It traces its role in court, its spread to the provinces (an aspect of Romanization) and its influence on the evolution of Roman law. Elizabeth Meyer reveals how Roman legal documents on tablets are the ancestors of today's dispositive legal documents--the document as the act itself. In a world where knowledge of Roman law was scarce (and enforcers scarcer), Roman law drew its authority from a wider world of belief.

Women, Money, and the Law: Nineteenth-Century Fiction, Gender, and the Courts
By Joyce W. Warren

--------------------------------------------------------------------------------

Publisher:  University Of Iowa Press
Number Of Pages:  384
Publication Date:  2005-12-01
ISBN-10 / ASIN:  0877459533
ISBN-13 / EAN:  9780877459538
Binding:  Hardcover

--------------------------------------------------------------------------------

Product Description:

Did 19th-century American women have money of their own? To answer this question, Women, Money, and the Law looks at the public and private stories of individual women within the context of American culture, assessing how legal and cultural traditions affected women's lives, particularly with respect to class and racial differences, and analyzing the ways in which women were involved in economic matters. Joyce Warren has uncovered a vast, untapped archive of legal documents from the New York Supreme Court that had been expunged from the official record. By exploring hundreds of court cases involving women litigants between 1845 and 1875--women whose stories had, in effect, been erased from history--and by studying the lives and works of a wide selection of 19th-century women writers, Warren has found convincing evidence of women's involvement with money. The court cases show that in spite of the most egregious gender restrictions of law and custom, many 19th-century women lived independently, coping with the legal and economic restraints of their culture while making money for themselves and often for their families as well. They managed their lives and their money with courage and tenacity and fractured constructed gender identities by their lived experience. Many women writers, even when they did not publicly advocate economic independence for women, supported themselves and their families throughout their writing careers and in their fiction portrayed the importance of money in women's lives. Women from all backgrounds--some defeated through ignorance and placidity, others as ruthless and callous as the most hardened businessmen--were in fact very much a part of the money economy. Together, the evidence of the court cases and the writers runs counter to the official narrative, which scripted women as economically dependent and financially uninvolved. Warren provides an illuminating counternarrative that significantly questions contemporary assumptions about the lives of 19th-century women. Women, Money, and the Law is an important corrective to the traditional view and will fascinate scholars and students in women's studies, literary studies, and legal history as well as the general reader.

The Gender Line: Men, Women, and the Law (Critical America)
By Nancy Levit

--------------------------------------------------------------------------------

Publisher:  NYU Press
Number Of Pages:  320
Publication Date:  1998-04-01
ISBN-10 / ASIN:  0814751210
ISBN-13 / EAN:  9780814751213
Binding:  Hardcover

--------------------------------------------------------------------------------

Product Description:

"Drawing on a variety of disciplines, Levit contends that both society generally and some feminists in particular have exaggerated the evidence of difference between males and females and have overlooked the far more prevalent similarities. . . . A readable, thoughtful, and controversial volume."
--Choice

"Interesting and important. . . . It should be compulsory reading in preparation for law study to stimulate and inspire individuals aspiring to learn to construct a society more egalitarian than we now know."
--Judge Norma L. Shapiro, Jurist

"The Gender Line marks feminism's coming of age. Levit tackles the issue of gender not just as it affects women, but as it constrains everyone. Her book brings new insight into the meaning of masculinity and femininity and their role in society."
--June Carbone, Santa Clara Law School

Despite tremendous advances in civil rights, we live in a world where the sexes remain sharply segregated from birth to death: in names, clothing, social groupings, and possessions; in occupations, civic association, and domestic roles. Gender separatism, so pervasive as to be almost invisible, permeates the fabric of our daily social routines. Preferring a notion of gender that is fluid and contextual, and denying that separatism is inevitable, Nancy Levit dismantles the myths of gender essentialism Drawing on a wealth of interdisciplinary data regarding the biological and cultural origins of sex differences, Levit provides a fresh perspective on gendered behaviors and argues the need for careful cultivation of new relations between the sexes.

With its focus particularly on men, The Gender Line offers an insightful overview of the construction of gender and the damaging effects of its stereotypes. Levit analyzes the ways in which law legitimizes the social segregation of the sexes through legal decisions regarding custody, employment, education, sexual harassment, and criminal law. In so doing, she illustrates the ways in which men's and women's oppressions are intertwined and how law molds the very definition of masculinity.

Applying feminist methodology to the doctrine of feminism itself, Levit artfully demonstrates that gender separatism infects even our contemporary views of feminism. Levit asks questions that have been too long been unspoken--those that lie at the core of the feminist project, yet threaten its very foundations. Revealing masculinity as both a privileged and a victimized condition, she calls for a step forward, past the bounds of contemporary feminism and its conflicts, toward a more egalitarian and inclusive feminism. This brand of feminism would reshape traditional masculinity, invite men into feminist dialogue, and claim men as political allies.
