Publication Date:1993-01-01
ISBN-10 / ASIN:0309048338

Book Description:
As technological developments multiply around the globe--even as the patenting of human genes comes under serious discussion--nations, companies, and researchers find themselves in conflict over intellectual property rights (IPRs). Now, an international group of experts presents the first multidisciplinary look at IPRs in an age of explosive growth in science and technology.
This thought-provoking volume offers an update on current international IPR negotiations and includes case studies on software, computer chips, optoelectronics, and biotechnology--areas characterized by high development cost and easy reproducibility. The volume covers these and other issues:
Modern economic theory as a basis for approaching international IPRs.
U.S. intellectual property practices versus those in Japan, India, the European Community, and the developing and newly industrializing countries.
Trends in science and technology and how they affect IPRs.
Pros and cons of a uniform international IPRs regime versus a system reflecting national differences.

Product Description:
The sixteen papers in this volume investigate the links between law and society during Late Antiquity (260-640 CE). On the one hand, they consider how social changes such as the barbarian settlement and the rise of the Christian church resulted in the creation of new sources of legal authority, such as local and "vulgar" law, barbarian law codes, and canon law. On the other, they investigate the interrelationship between legal innovations and social change.

Three Strikes Laws (Historical Guides to Controversial Issues in America)
By Jennifer E. Walsh
Publisher:Greenwood Press
Number Of Pages:208
Publication Date:2007-01-30
ISBN-10 / ASIN:031333708X
ISBN-13 / EAN:9780313337086
Binding:Hardcover
Product Description:
In the mid-1990s, policymakers in more than half the states and the federal government responded to escalating crime rates and a series of sensationalized crimes by passing laws that imposed lifetime sentences on repeat offenders. Since then, the "Three Strikes and You're Out" movement, which embodies the overall "get tough with crime" approach to criminal sentencing, has generated much controversy. Critics argue that Three Strike laws are disproportionate, costly, and inefficient. Supporters, however, argue that the laws are effective, necessary, and just. Despite the controversy, Three Strike laws are still popular more than a decade after their implementation. Attempts to reduce the scope and/or severity of Three Strike policies have failed and the laws continue to affect thousands of offenders each year. Setting the record straight, Walsh provides a clear, comprehensive overview of the movement and its consequences. Do Three Strikes laws really prevent crime? Do they cost less than releasing repeat offenders time and time again? Are they evenly and fairly applied? These questions and more are answered in these pages through a careful analysis of the costs, benefits, and results of Three Strikes legislation. Walsh analyzes the historical development of the Three Strikes movement in the context of "get tough" sentencing reforms and provides detail about the various Three Strikes statutes adopted across the nation, while offering an in-depth exmamination of the controversies they have produced. Amid efforts to repeal or revise such statutes, the laws still stand, and this book sheds light on the history of, rationale for, and results of one of the most controversial criminal justice movements of our time.

Sex Crimes Investigation: Catching and Prosecuting the Perpetrators
By Robert L. Snow
Publisher:Praeger Publishers
Number Of Pages:220
Publication Date:2006-04-30
ISBN-10 / ASIN:0275989348
ISBN-13 / EAN:9780275989347
Binding:Hardcover
Product Description:
No one wants to be robbed at gunpoint, or have his car stolen, or his house robbed. When these crimes happen, victims may feel angry, afraid, or violated. But there is no violation quite so devastating as sexual assault. Victims do not recover easily--either emotionally, psychologically, or physically from such incidents, and the long-term impact can be devestating to the victims, their families, and communities. Investigating violent sex crimes is particularly difficult for many reasons. Often the collection of evidence requires a full medical examination of the victim--a second violation of sorts. Police must interview the victim, who must recount his or her assault. Often, the victims are children, and offenders range from family members to perfect strangers. But investigating and prosecuting these crimes is crucial to the healing process of many victims, and to the safety of society at large. Detective Snow takes readers on a tour of the ways in which the police investigate and help prosecute such crimes. Each chapter begins with a real-life incident and throughout the book real stories are used to illustrate each step in the process. Snow addresses the processing of the crime scene, the collection of evidence, the development of suspects, the questioning of witnesses and perpetrators, and the preparation for trial. Few members of the public have any idea how complex and delicate the investigation of sex crimes really is. This book sheds light on this important police work and helps readers understand how these crimes are investigated, solved, and prosecuted. Victims and their families will especially benefit from the information in this book, but all readers will gain insight into the crimes, their incidence, their impact on victims, and the way the criminal justice system responds, from the scene of the crime through the capture and incarceration of the perpetrators.

Punishment: The Supposed Justifications Revisited

Publication Date:2005-12-16
ISBN-10 / ASIN:0745321313
ISBN-13 / EAN:9780745321318

Product Description:
Ted Honderich's Punishment is the best-known book on the justifications put forward for state punishment. This enlarged and developed edition brings his writing to a new audience. With new chapters on determinism and responsibility, plus a new conclusion, the book also remains true to its original realism about almost all talk of retribution and proportionality. Honderich investigates all the commonsensical notions of why and when punishment is morally necessary, engaging with the language of public debate by politicians and other public figures. Honderich then puts forward his own argument that punishment is legitimate when it is in accord with the principle of humanity.
Written in a clear, sharp style and seasoned with a dry wit, this is the most important work on the reasoning behind our penal systems. It is a pleasure to read for philosophers and non-philosophers alike.
Ted Honderich is Grote Professor Emeritus at University College London and author of numerous books on philosophy, including After the Terror (Edinburgh University Press, 2002), How Free Are You? (Oxford University Press, 2001), Terrorism for Humanity (Pluto Press, 2003) and Conservatism (Pluto Press, 2005). He is also the editor of the Oxford Companion to Philosophy.

State Crime: Governments, Violence and Corruption
By Penny Green, Tony Ward

Publication Date:2004-01-20
ISBN-10 / ASIN:0745317847
ISBN-13 / EAN:9780745317847

Book Description:
This is an introductory text which defines the field and sets out the parameters of state crime in all its forms: state violence, corruption, transnational crime, state involvement in corporate crime, in avoidable ‘natural’ disasters, torture and illegal punishment, criminal policing, war crimes and genocide.
It incorporates a thorough review of the themes, issues, and debates central to the existing literature on state crime, drawn from a range of disciplines, including criminology, human rights, international relations and political science; and develops a theoretical approach to understanding the boundaries of state crime in relation to both deviance and human rights. A distinctive feature of the book is its original empirical research which uses diverse international and thematically organised case-studies to inform it.

Act of Justice

ISBN-10 / ASIN:0813124638

Product Description:
In his first inaugural address, Abraham Lincoln declared that as president he would “have no lawful right” to interfere with the institution of slavery. Yet less than two years later, he issued a proclamation intended to free all slaves throughout the Confederate states. When critics challenged the constitutional soundness of the act, Lincoln pointed to the international laws and usages of war as the legal basis for his Proclamation, asserting that the Constitution invested the president “with the law of war in time of war.”
As the Civil War intensified, the Lincoln administration slowly and reluctantly accorded full belligerent rights to the Confederacy under the law of war. This included designating a prisoner of war status for captives, honoring flags of truce, and negotiating formal agreements for the exchange of prisoners—practices that laid the intellectual foundations for emancipation. Once the United States allowed Confederates all the privileges of belligerents under international law, it followed that they should also suffer the disadvantages, including trial by military courts, seizure of property, and eventually the emancipation of slaves.
Even after the Lincoln administration decided to apply the law of war, it was unclear whether state and federal courts would agree. After careful analysis, author Burrus M. Carnahan concludes that if the courts had decided that the proclamation was not justified, the result would have been the personal legal liability of thousands of Union officers to aggrieved slave owners. This argument offers further support to the notion that Lincoln’s delay in issuing the Emancipation Proclamation was an exercise of political prudence, not a personal reluctance to free the slaves.
In Act of Justice, Carnahan contends that Lincoln was no reluctant emancipator; he wrote a truly radical document that treated Confederate slaves as an oppressed people rather than merely as enemy property. In this respect, Lincoln’s proclamation anticipated the psychological warfare tactics of the twentieth and twenty-first centuries. Carnahan’s exploration of the president’s war powers illuminates the origins of early debates about war powers and the Constitution and their link to international law.

Product Description:
Few questions in psychology have generated as much debate as those concerning the impact of childhood trauma on memory. A lack of scientific research to constrain theory has helped fuel arguments about whether childhood trauma leads to deficits that result in conditions such as false memory or lost memory, and whether neurohormonal changes that are correlated with childhood trauma can be associated with changes in memory. Scientists have also struggled with more theoretical concerns, such as how to conceptualize and measure distress and other negative emotions in terms of, for example, discrete emotions, physiological response, and observer ratings. To answer these questions, Mark L. Howe, Gail Goodman, and Dante Cicchetti have brought together the most current and innovative neurobiological, cognitive, clinical, and legal research on stress and memory development. This research examines the effects of early stressful and traumatic experiences on the development of memory in childhood, and elucidates how early trauma is related to other measures of cognitive and clinical functioning in childhood. It also goes beyond childhood to both explore the long-term impact of stressful and traumatic experiences on the entire course of "normal" memory development, and determine the longevity of trauma memories that are formed early in life. Stress, Trauma, and Children's Memory Development will be a valuable resource for anyone interested in early experience, childhood trauma, and memory research.

Understanding Criminal Justice: Sociological Perspectives
By Philip D Smith, Kristin Natalier
Publisher: Sage Publications Ltd
Number Of Pages: 240
Publication Date: 2004-11-18
ISBN-10 / ASIN: 0761940324
ISBN-13 / EAN: 9780761940326
Binding: Paperback
Product Description:
'This book traverses an impressive array of topics and problems central to law and criminal justice. Its accessibility, contemporary themes and sensitivity to issues of inequality make it a perfect text for students and teachers of sociology, law, criminology, legal studies and other related areas. It is rare to find a book that takes the sociological imagination so successfully into fields that are often viewed as the domain for legal professionals only. The well-chosen examples also make it a valuable resource for scholars with experiences of different justice systems' - Sharyn L Roach Anleu, Flinders University
`Smith and Natalier have produced an accessible, wide-ranging and lucid text which sets the major questions of criminal justice within the broad framework of classical and contemporary sociological theory. It represents a significant step forward among teaching texts in the field, synthesising some difficult material without over-simplifying it, and providing a broad-overview without losing sight of the texture of discreet issues’ - Professor Nicola Lacey, London School of Economics
Is there really an intrinsic link between the law and our criminal justice system? What exactly is it and can an understanding of wider sociological issues tell us anything about this relationship?
Understanding Criminal Justice addresses the fundamental relationship between law and the criminal justice system, and the ways in which both are intimately connected with wider social forces.
The book provides an essential introduction coverering classic themes, debates and literatures to ground the student before moving on to contemporary themes such as globalisation, internet regulation and the media. The subject matter is contextualised within the wider social framework by calling into play the historical, political, community and cultural inputs that impact upon concrete policies and practice. The authors integrate theory with data and examples from the UK, USA and Australia.
Through the inclusion of the following pedagogical devices, the student is encouraged to more fully and independently develop their understanding of key questions and issues:
" review questions and exercises
" further reading lists
" suggested internet sites
" highlighted key terms
" bullets to summarise key points
" boxed sections on themes, definitions and case studies
This comprehensive overview is ideal for 1st and 2nd year undergraduates in Criminology, Criminal Justice Studies, Law, Legal Studies, Sociology, Social Work and Policing. Having used this text the reader will come to appreciate the myriad paths through which law and the criminal justice system play a vital, if contested, role in our society.

Performing Israel's Faith: Narrative and Law in Rabbinic Theology

Product Description:
If law alone yields legalism, then religious belief, by itself, fails to create justice. In Performing Israel's Faith, Jacob Neusner shows how Jewish Halakhah (law) and Aggadah (narrative) fit together to form a robust and coherent covenant theology--one directly concerned about this world. Neusner's careful and thorough examination of several key issues within Rabbinic Judaism--the nations, idolatry, sin, repentance, and atonement--demonstrates that neither Halakhah nor Aggadah can be fully and rightly understood in isolation from each other. Performing Israel's Faith thus effectively reveals that Rabbinic Judaism's true pattern of religion was constituted by a covenant theology comprised by both law and story--a covenant theology whose aim was to restore the sanctification of God's original creation.

Product Description:
"A voice of reason, wisdom and compassion, Eric Yamamoto brings rich practical experience and analytic insight to the crucial subject of healing and reconciliation between groups divided by histories of oppression and mistreatment. This book is vital reading for anyone interested in creating a just world.
--Martha Minow, Harvard Law School, Author of Between Vengeance and Forgiveness: Facing History after Genocide
"A stunningly original and moving work that dramatically expands the national dialogue on race. . . . Yamamoto presents a multidisciplinary, praxis-oriented approach to confronting conflict among communities of color. He provides us with the concepts, the methods, and the language to understand and grapple with the messy nature of reconciliation between racialized groups. His vision of interracial justice is compelling, inspiring, and essential to averting the fire next time."
--Michael Omi, University of California, Berkeley
"Remarkable. A must read for all activists."
--Yuri Kochiyama
"Yamamoto's analysis offers an important insight: A group can simultaneously be oppressed by others more powerful than it and also oppress others less powerful. . . . A pragmatic model for how interracial justice may someday be real."
--The Hawaii Herald
"Inspiring and energizing, disturbing and challenging, informative and inquisitive, Interracial Justice is a thoroughly researched, even ground-breaking, tour de force."
—Berta Esperanza Hernández-Truyol, St. John's University
The United States in the twenty-first century will be a nation of so-called minorities. Shifts in the composition of the American populace necessitate a radical change in the ways we as a nation think about race relations, identity, and racial justice.
Once dominated by black-white relations, discussions of race are increasingly informed by an awareness of strife among nonwhite racial groups. While white influence remains important in nonwhite racial conflict, the time has come for acknowledgment of ways communities of color sometimes clash, and their struggles to heal the resulting wounds and forge strong alliances.
Melding race history, legal theory, theology, social psychology, and anecdotes, Eric K. Yamamoto offers a fresh look at race and responsibility. He tells tales of explosive conflicts and halting conciliatory efforts between African Americans and Korean and Vietnamese immigrant shop owners in Los Angeles and New Orleans. He also paints a fascinating picture of South Africa's controversial Truth and Reconciliation Commission as well as a pathbreaking Asian American apology to Native Hawaiians for complicity in their oppression. An incisive and original work by a highly respected scholar, Interracial Justice greatly advances our understanding of conflict and healing through justice in multiracial America.
