摘要：善意取得制度作为一项古老而重要的民法制度，其构成要件已日臻完善。然而随着社会经济的不断发展，特别是我国《物权法》施行不久，善意取得制度仍有许多值得反复探究之处。本文拟将善意取得制度从规范民事财产权归属交易所构建的法律体系中抽离出来，视为一种独立制度，并与原法律体系的一般规定进行比较，探讨善意取得制度的概念、立法目的、法律效果的性质、理论依据以及其根本性制度设计在运作过程中对原法律体系的影响，以确立该制度在整体民事财产法体系中的原则定位。由于动产善意取得在善意取得制度中最为完整，故拟以该规范为主要研究对象，作为探讨上述问题的起点。
