American Law in the Age of Hypercapitalism: The Worker, the Family, and the State (Critical America)

By Ruth Colker
—————————————————————————————————————————————————————
Publisher:  NYU Press
Number Of Pages:  250
Publication Date:  1998-03-01
ISBN-10 / ASIN:  081471563X
ISBN-13 / EAN:  9780814715635
—————————————————————————————————————————————————————

Product Description:

Since the fall of communism, laissez-faire capitalism has experienced renewed popularity. Flush with victory, the United States has embraced a particularly narrow and single-minded definition of capitalism and aggressively exported it worldwide. The defining trait of this brand of capitalism is an unwavering reverence for the icons of the market. Although promoted as a laissez-faire form of capitalism, it actually reflects the very evils of selfishness and greed by entrepreneurs that concerned Adam Smith.
Capitalism, however, can thrive without an extreme emphasis on efficiency and personal autonomy. Americans often forget that theirs is a rather peculiar form of capitalism, that other Western nations successfully maintain capitalistic systems that are fundamentally more balanced and nuanced in their effect on society. The unnecessarily inhumane aspects of American capitalism become apparent when compared to Canadian and Western European societies, with their more generous policies regarding affirmative action, accommodation for disabled persons, and family and medical leave for pregnant woman and their partners.
In American Law in the Age of Hypercapitalism, Ruth Colker examines how American law purports to reflect--and actively promotes--a laissez-faire capitalism that disproportionately benefits the entrepreneurial class. Colker proposes that the quality of American life depends also on fairness and equality rather than simply the single-minded and formulaic pursuit of efficiency and utility.

Higher Education Law: The Faculty

By Mr. Steven G. Poskanzer
—————————————————————————————————————————————————————
Publisher:  The Johns Hopkins University Press
Number Of Pages:  368
Publication Date:  2001-11-21
ISBN-10 / ASIN:  0801867487
ISBN-13 / EAN:  9780801867484
—————————————————————————————————————————————————————
Product Description:
"Do we need to talk to our lawyers about this?"
"What do the attorneys say?"
"Why didn't you get the lawyers involved before now?"
Just about every department chair and dean, certainly every provost and president, and an ever-increasing number of faculty find themselves asking—or being asked—such questions. Dealing with issues ranging from academic freedom to job security and faculty discipline, lawyers, legal requirements, and lawsuits has become an established part of the apparatus of American higher education.
Higher Education Law was written to help faculty and administrators navigate critical legal issues and avoid potential legal pitfalls. Drawing on his experience as university counsel, administrator, and teacher at a number of institutions, Steven G. Poskanzer explains the law as it pertains to faculty activities both inside and outside the academy, including faculty roles as scholars, teachers, and members of institutional communities, as well as employees and public citizens. In each of these areas, he expands his discussion of cases and decisions to set out his own views both on the current status of the law and how it is likely to evolve.

Hybrid: Bisexuals, Multiracials, and Other Misfits Under American Law (Critical America Series)

By Ruth Colker

—————————————————————————————————————————————————————
Publisher:  NYU Press
Number Of Pages:  320
Publication Date:  1996-05-01
ISBN-10 / ASIN:  0814715389
ISBN-13 / EAN:  9780814715383
—————————————————————————————————————————————————————
Product Description:

Ruth Colker's Hybrid is an ambitious study of the U.S. legal system and the binary lens through which it determines justice. U.S. Courts, according to Colker, not only neglect to address the reality of bisexuals, multiracials, transgenderists, and many people with disabilities, but also fail to acknowldedge the varied ways that race, sex and ability are constructed in U.S. society. She offers a critique of the U.S. legal system and suggests strategies for working with these issues in the future.
--Committee on Lesbian and Gay History Newsletter
The United States, and the West in general, has always organized society along bipolar lines. We are either gay or straight, male or female, white or not, disabled or not.
In recent years, however, America seems increasingly aware of those who defy such easy categorization. Yet, rather than being welcomed for the challenges that they offer, people living the gap are often ostracized by all the communities to which they might belong. Bisexuals, for instance, are often blamed for spreading AIDS to the heterosexual community and are regarded with suspicion by gays and lesbians. Interracial couples are rendered invisible through monoracial recordkeeping that confronts them at school, at work, and on official documents. In Hybrid, Ruth Colker argues that our bipolar classification system obscures a genuine understanding of the very nature of subordination. Acknowledging that categorization is crucial and unavoidable in a world of practical problems and day-to-day conflicts, Ruth Colker shows how categories can and must be improved for the good of all.

Culture Clash: Law and Science in America

By Steven Goldberg
—————————————————————————————————————————————————————
Publisher:  NYU Press
Number Of Pages:  255
Publication Date:  1994-09-01
ISBN-10 / ASIN:  0814730574
ISBN-13 / EAN:  9780814730577
—————————————————————————————————————————————————————

Product Description:

"Culture Clash--with its rare blend of creativity, verbal skill and balanced judgement--helps to clarify the understanding of law and science in American life."
—New York Law Journal
"A lucid and entertaining mix of constitutional law and history."
—American Journal of Human Genetics
"One of the most vital interdisciplinary works of this generation. A trenchant, thought-provoking, and immensely readable analysis of the important issues at the intersection of law, science, and morality. Goldberg, perhaps the most prominent and certainly the most prolific legal scholar in the law and science field, explores the most contemporary topics at the frontiers of current scientific, technological, legal, and moral inquiry. An accomplished and important book."
—Nancy Levit,Associate Professor of Law, University of Missouri-Kansas City,Co-author of Jurisprudence
"Draws on more than a decade's work to bring together in one place a remarkably broad treatment of the relationship between law and science. All of the well-known issues are addressed: the legal questions likely to arise from current research aimed at mapping the human genome, the legal debates over the public schools' treatment of creationism and evolution, the effect of federal agency practices on the course of scientific research, and the use of scientific evidence in legal disputes...Certain to enrich all future discussion of these topics."
—Ira Mark Ellman,Professor of Law, Arizona State University
It is an article of faith in America that scientific advances will lead to wondrous progress in our daily lives. Americans proudly support scientific research that yields stunning breakthroughs and Nobel prizes. We relish the ensuing debate about the implications—moral, ethical, practical—of these advances. Will genetic engineering change our basic nature? Will artificial intelligence challenge our sense of human uniqueness? And yet the actual implementation of these technologies is often sluggish and much-delayed. From Star Trek to Jurassic Park, the American imagination has always been fascinated by the power of scientific technology. But what does the reality of scientific progress mean for our society?
In this controversial book, Steven Goldberg provides a compelling look at the intersection of two of America's most powerful communities—law and science—to explain this apparent contradiction. Rarely considered in tandem, law and science highlight a fundamental paradox in the American character, the struggle between progress and process. Science, with its ethic of endless progress, has long fit beautifully with America's self image. Law, in accordance with the American ideal of giving everyone a fair say, stresses process above all else, seeking an acceptable, rather than a scientifically correct, result. This characteristic has been especially influential in light of the explosive growth of the legal community in recent years.
Exposing how the legal system both supports and restricts American science and technology, Goldberg considers the role and future of three projects—artificial intelligence, nuclear fusion, and the human genome initiative—to argue for a scientific vision that infuses research with social goals beyond the pure search for truth. Certain to provoke debate within a wide range of academic and professional communities, Culture Clash reveals one of the most important and defining conflicts in contemporary American life.

The Rule of Law in America

By Professor Ronald A. Cass

—————————————————————————————————————————————————————
Publisher:  The Johns Hopkins University Press
Number Of Pages:  232
Publication Date:  2001-09-04
ISBN-10 / ASIN:  0801867282
ISBN-13 / EAN:  9780801867286
—————————————————————————————————————————————————————

Product Description:
What is the rule of law? Why does it matter? How well does America conform to the rule of law? And why do Americans, who profess such respect for the law, complain so often about our legal system? Drawing upon extensive experience in law, government service, teaching, and research, Boston University law school dean Ronald Cass offers a welcome contribution to the ongoing public discussion on law and society.
After opening his discussion with chapters on the rule of law in American society, Cass turns to the hard case of its application to the president of the United States. Through this prism Cass examines the behavior of judges who may not always act according to a "perfect model." Instead, says Cass, "looking at the ordinary case—and asking not whether the decision advances particular aspirations for society, but whether it conforms to basic aspects of legal authority—produces a more law-governed view of America judging." In fact, this book provides a much-needed corrective to criticism of the American legal system raised all too frequently by some members of the academy. Rather than concentrating on relatively minor inconsistencies in the law and slight departures from the ideal of perfectly constrained decision making, Cass argues that the energies of his fellow scholars could be better spent on more serious defects in the legal system. With a special section on the 2000 presidential election, including the Florida recount and Supreme Court decision, The Rule of Law in America offers a timely look at a subject of interest to legal scholars and general readers alike.

The Art of Alibi: English Law Courts and the Novel

By Professor Jonathan H. Grossman
—————————————————————————————————————————————————————
Publisher:  The Johns Hopkins University Press
Number Of Pages:  216
Publication Date:  2002-01-23
ISBN-10 / ASIN:  080186755X
ISBN-13 / EAN:  9780801867552
—————————————————————————————————————————————————————

Product Description:
In The Art of Alibi, Jonathan Grossman reconstructs the relation of the novel to nineteenth-century law courts. During the Romantic era, courthouses and trial scenes frequently found their way into the plots of English novels. As Grossman states, "by the Victorian period, these scenes represented a powerful intersection of narrative form with a complementary and competing structure for storytelling." He argues that the courts, newly fashioned as a site in which to orchestrate voices and reconstruct stories, arose as a cultural presence influencing the shape of the English novel.
Weaving examinations of novels such as William Godwin's Caleb Williams, Mary Shelley's Frankenstein, and Charles Dickens's The Pickwick Papers and Oliver Twist, along with a reading of the new Royal Courts of Justice, Grossman charts the exciting changes occurring within the novel, especially crime fiction, that preceded and led to the invention of the detective mystery in the 1840s.

Publisher:  Oxford University Press, USA
Number Of Pages:  144
Publication Date:  1996-05-23
ISBN-10 / ASIN:  0198262418
ISBN-13 / EAN:  9780198262411
—————————————————————————————————————————————————————

Product Description:
Andrew von Hirsch addresses a number of emerging conceptual questions concerning the proportionality of criminal sentences, an approach that is gaining influence worldwide including in England where the Criminal Justice Act of 1991 made proportionality the primary criterion for determining sentences. This study deals with how the idea of penal censure justifies proportionate sentences, how a penalty scale should be "anchored" in order to reduce overall punishment levels, how non-custodial penalties should be graded and used, and how political pressures impinge on sentencing policies. It offers a coherent and humane way of allocating punishments, appropriate for a society that treats convicted offenders as citizens whose rights and choices should continue to be respected.

Governments, Labour, and the Law in Mid-Victorian Britain: The Trade Union Legislation of the 1870s (Oxford Historical Monographs)

By Mark Curthoys
————————————————————————————————————————————
Publisher:  Oxford University Press, USA
Number Of Pages:  304
Publication Date:  2004-08-19
ISBN-10 / ASIN:  0199268894
ISBN-13 / EAN:  9780199268894
————————————————————————————————————————————

Product Description:
After the repeal of the Combination Acts in the 1820s, collective labour enjoyed limited freedoms. When that regime collapsed under judicial challenge during the 1860s, governments were obliged to devise a new legal frameworks for trade unions and strikes. This study traces how, in adjudicating between opposing conceptions of 'free trade' and 'free labour', official opinion came to favour an unrestricted freedom to combine, and sought to withdraw the criminal law from industrial relations. It also reveals the impact upon policy-makers of the contemporary assaults upon classical political economy, and of the historicized critiques of labour law propounded by Liberal writers. Drawing upon previously unused governmental sources, this account provides many wider insights into the nature and inner-workings of the mid-Victorian state.

Effigy: Images of Capital Defendants (Issues in Crime & Justice)

By Allison Cotton
————————————————————————————————————————
Publisher:  Lexington Books
Number Of Pages:  230
Publication Date:  2008-07-28
ISBN-10 / ASIN:  0739125516
ISBN-13 / EAN:  9780739125519
————————————————————————————————————————
Description:
Effigy examines the images of a capital defendant portrayed during the guilt and penalty phases of a capital trial, the trial tactics used by attorneys to impart these images, and the consequences that result from the jury's attempt to reconcile contradictory images to place one in permanent record as a verdict. These images are starkly contrasted against the backdrop of a brutal murder in which the stereotypes of American fear are realized: Donta Page, the defendant, is an African American male from a low-income segment of society while Peyton Tuthill, the victim, was a Caucasian female from a middle-income suburb.
