A Good, but necessarily limited, intro to the legal system

Overall, I'd give this a positive rating, but since it's written for all 50 states, it is so broad in its coverage that it makes it difficult to learn about how to pursue your lawsuit in your particular state.
I'd suggest reading this book and trying to fill out forms as you go. Pick up the 'local rules' from your own court, and study them for what Bergman doesn't tell you.
One thing I will say, though, is that one bit of advice was invaluable...on visiting the court before your motion or case is heard. I did this, and it took a lot of the mystery out of the whole process.
By doing this, by the way, I was completely surprised that (in the motion hearings) that most of what took place was pretty much on a par with small claims court, with a few legal latin phrases peppering the give-and-take. Most of the motions I heard consisted of two things: Why one or the other party failed to meet deadlines, and trying to get the other guy's case thrown out before everyone went to trial.
One other thing that was also surprising...the opposing lawyers where pretty buddy-buddy with each other. I guess the hostility and animosity that one would associate with a lawsuit pretty much reside only in the parties to the suit themselves.
In my appearance, I took it very cool and did not act emotional at all. Let's face it...the court doesn't want to hear it. They just want to get done so they can go to lunch.

This is a search of a model for a humane law - where the cruelty ban is still in force. This book however is not intended as an utopian enterprise; the humane law which is looked for is not for the future, nor is it meant as a reform project, or as a programme for new institutions to come. Here the contention is that positive law is better understood, if it is not too easily equated with power, force, or command. Law - it is shown - is more a matter of discourse and deliberation, than of sheer decision or of power relations. Constitutionalism, legal argumentation, legal ethics - three fundamental moments of our daily experience with the law - are there to witness that this view may be right. Now a "constitutional" view of the law and its practice and the connected discoursive approach to legal reasoning can offer interesting solutions also to legal ethics. If we take legal reasoning seriously, and conceive it in a "liberal" way comprising both lawyers and judges, so that adjudication is both a task for advocates and judges, the requirement of separation of powers on the one side is already full of implications for lawyers' deontology: the role of a lawyer will not be allowed to encroach with the one fulfilled by the statesman. On the other side, the claim of rightness intrinsic in legal discourse cannot avoided by lawyers. So that they could no longer be seen as defenders of clients' interests, but of their rights. And rights are claims to be right. Thus the requirement of justice, or better a certain threshold imposed on the tolerable injustice of the legal claim raised, will be inescapable not only for the judge, but to the lawyer as well. The general idea of this book may unfortunately run counter recent developments in the international arena and more generally in the less palpable Zeitgeist. It might well be that, like Hegel's owl that takes flight at sunset, a conceptual pattern is set forth while the corresponding institutional practice is beginning to die out.

In a nation-building operation, outside states invest much of their resources in establishing and maintaining the host country's police, internal security forces, and justice system. Strengthening all these elements is crucial for achieving sustainable law and order. This book examines in detail the post-Cold War reconstruction efforts of Iraq, Afghanistan, and Kosovo, three major cases in which the United States and its allies have attempted to reconstruct security institutions. It then compares them with similar but smaller projects in Panama, El Salvador, Somalia, Haiti, Bosnia, and East Timor. In doing so, the authors make three main arguments. First, establishing security during the "golden hours" the period immediately following major combat operations should be the most significant concern of policymakers. Second, building a functioning justice system is a critical and often overlooked task of rebuilding security. Third, the authors provide rough guidelines for successfully reconstructing security after a major combat operation, including recommended force-to-population ratios, financial assistance, and duration of reconstruction. For future policy recommendations, the authors encourage decisionmakers to consider such principal elements as negotiating formal peace treaties or surrenders, establishing of comprehensive post-conflict doctrine, and using outcome-based metrics to measure success.
