自带酒水去酒楼,然后对老板收取“开瓶费”的要求说“NO”?不行!至少法律上行不通。
备受关注的北京首例“开瓶费”终审判决如下:酒店退还消费者“100元开瓶费”,但判决的理由是酒楼没有收费“明示”。这将意味着,有收费“明示”的酒店可以向消费者合法索要“开瓶费”。
