Freedom and Time: A Theory of Constitutional Self-Government

By Jed Rubenfeld

Publication Date:2001-03-01
ISBN-10 / ASIN:0300080484
ISBN-13 / EAN:9780300080483
————————————————————————————————————————————
Product Description:
Should we try to live in the present? Such is the imperative of modernity, Jed Rubenfeld writes in this important and original work of political theory. Since Jefferson proclaimed that 'the earth belongs to the living', since Freud announced that mental health requires people to 'get free of their past', since Nietzsche declared that the happy man is the man who 'leaps into the moment', modernity has directed its inhabitants to live in the present, as if there alone could they find happiness, authenticity, and above all freedom. But this imperative, Rubenfeld argues, rests on a profoundly inadequate, deforming picture of the relationship between freedom and time. Instead, Rubenfeld suggests, human freedom, indeed human being itself, necessarily extends into both past and future; self-government consists of giving our lives meaning and purpose over time. From this conception of self-government, Rubenfeld derives a new theory of constitutional law's place in democracy. Democracy, he writes, is not a matter of governance by the present 'will of the people'; it is a matter of a nation's laying down and living up to enduring political and legal commitments. Constitutionalism is not counter to democracy, as many believe, or a pre-condition of democracy; it is or should be democracy itself over time. On this basis, Rubenfeld offers a new understanding of constitutional interpretation and of the fundamental right of privacy.

Despite the unique nature of each scenario, using a standardized protocol is the key to ensuring consistent and accurate results. Death Scene Investigation: A Field Guide provides concise direction for the death scene investigator, crime scene investigator, coroner, medical examiner, or anyone associated with the investigation of death.

Since the majority of deaths are due to natural causes, the book emphasizes these situations, yet also examines unnatural circumstances. It begins by providing a general overview of death investigation before delving into a chronological point-by-point analysis of the death scene. Topics discussed include how to assess the body at the scene, and how to investigate natural and unnatural deaths.

Explores Various Causes
Next, the text demonstrates how death manifests in various parts of the body. A section on traumatic injuries examines and demonstrates with color photographs blunt force, sharp force, and a host of other injuries that the death examiner is likely to confront.
The book addresses identification methods and explores how to determine signs of resuscitation and previous surgeries. It concludes with a discussion of the purpose and performance of the autopsy and provides a survey of the different forensic experts that may become useful to the death investigator.
Enhanced by numerous color photos, this volume is a direct, succinct handbook that is invaluable to those that confront the reality of death on a day-to-day basis. Its convenient format makes it the perfect guide to take along to the scene.

The Constitution and the New Deal

By G. Edward White

Number Of Pages:400
Publication Date:2000-12-15
ISBN-10 / ASIN:0674003411
ISBN-13 / EAN:9780674003415
————————————————————————————————————————————
Product Description:
In a wholly new narrative of power and force, G. Edward White challenges the reigning understanding of twentieth-century Supreme Court decisions, particularly in the New Deal period. He does this by rejecting such misleading characterizations as "liberal," "conservative," and "reactionary," and by reexamining several key topics in constitutional law.
Through a close reading of sources and analysis of the minds and sensibilities of a wide array of justices, including Holmes, Brandeis, Sutherland, Butler, Van Devanter, and McReynolds, White rediscovers the world of early-twentieth-century constitutional law and jurisprudence. He provides a counter-story to that of the triumphalist New Dealers. The deep conflicts over constitutional ideas that took place in the first half of the twentieth century are sensitively recovered, and the morality play of good liberals vs. mossbacks is replaced. This is the only thoroughly researched and fully realized history of the constitutional thought and practice of all the Supreme Court justices during the turbulent period that made America modern.

The Use of Forensic Anthropology, Second Edition

By Robert B. Pickering, David Bachman
————————————————————————————————————————————
Publisher:CRC
Number Of Pages:184
Publication Date:2009-01-22
ISBN-10 / ASIN:1420068776
ISBN-13 / EAN:9781420068771
————————————————————————————————————————————
Product Description:
A forensic investigation requires a team of specialists from many different scientific fields of study along with legal and law enforcement specialists. In recent years, the range of cases on which forensic anthropologists have been consulted has expanded dramatically. The Use of Forensic Anthropology, Second Edition provides these professionals with guidelines for determining how to choose and when to use a forensic anthropologist.
The book begins with a historical overview of the field of forensic anthropology, and then presents basic information about how to approach a forensic recovery site. When skeletal or severely decomposed remains are discovered, normal methods of identification such as facial recognition and fingerprinting are ineffective. This book offers insights on how to find the right professional to assist with these difficult cases.
Ten Questions that Must be Answered in Every Case
One of the key features is a chapter which presents a series of 10 questions that must be answered, in order, about each case. Using this checklist will ensure the team working on the case that no stone is left unturned. Later chapters examine the relevance of race, ethnicity, and ancestry, determination of time of death, new investigation techniques, DNA, and categories of trauma. The final chapter brings the various parts of the process together to reconstruct a case.
The first responder to a scene with skeletal remains and the law enforcement agencies who become involved will likely be confronted with evidence that they cannot interpret. This volume provides a bridge for these professionals, enabling them to develop a standard protocol for investigating skeletal remains, highlighting important questions that must be answered, and assisting them in finding the right forensic anthropologist to solve the puzzle of an unexplained death.

Summary
"Addresses the issue of reparations for the forced eviction and displacement of Maya Achi communities in Guatemala, specifically in the context of the construction of the Pueblo Viejo-Quixal Hydroelectric Project (Chixoy Dam). Between 1980 and 1982, an estimated 440 persons of the Rio? Negro community were brutally murdered in a series of massacres ... Both the Inter-American Development Bank (IDB) and the World Bank provided funding for and supervised the Chixoy Dam Project. The Chixoy Dam case clearly highlights the complicity of international financial institutions, including the IDB and the World Bank, in the brutal and unlawful displacement of indigenous communities from their lands in Guatemala"--Back cover.

Knowledge Discovery for Counterterrorism and Law Enforcement (Chapman & Hall/Crc Data Mining and Knowledge Discovery)

By David Skillicorn
————————————————————————————————————————————
Publisher:CRC
Number Of Pages:332
Publication Date:2008-11-13
ISBN-10 / ASIN:1420073990
ISBN-13 / EAN:9781420073997
————————————————————————————————————————————
Product Description:
Most of the research aimed at counterterrorism, fraud detection, or other forensic applications assumes that this is a specialized application domain for mainstream knowledge discovery. Unfortunately, knowledge discovery changes completely when the datasets being used have been manipulated in order to conceal some underlying activity. Knowledge Discovery for Counterterrorism and Law Enforcement operates from the premise that detection algorithms must be rethought to be effective in this domain, and presents a new approach based on cutting-edge analysis for use in adversarial settings.
Reveals How Criminals Conceal Information
This volume focuses on four main forms of knowledge discovery: prediction, clustering, relationship discovery, and textual analysis. For each of these application areas, the author discusses opportunities for concealment that are available to criminals and reveals some of the tactics that can aid in detecting them. He reviews what is known about the different technologies for each area and evaluates their effectiveness. The book also supplies a preview of technologies currently under development and describes how they will fit in to existing approaches to knowledge discovery.
Provides Proactive Formulas for Staying One Step Ahead of Adversaries
While all knowledge-discovery systems are susceptible to manipulation, designers and users of algorithmic systems who are armed with the knowledge of these subversive tactics are better able to create systems to avoid these vulnerabilities. This book delineates an effective process for integrating knowledge-discovery tools, provides a unique understanding of the limits of the technology, and contains a clear presentation of the upsides and pitfalls of data collection. It is a powerful weapon in the arsenal of anyone confronting the increasingly sophisticated tactics employed by lawbreakers and other unsavory individuals.

From Newton's Sleep

By Joseph Vining
————————————————————————————————————————
Publisher:Princeton University Press
Number Of Pages:416
Publication Date:1994-11-29
ISBN-10 / ASIN:0691034877
ISBN-13 / EAN:9780691034874
————————————————————————————————————————
Product Description:
What does the presence of law say of the beliefs of individuals in a society--their actual beliefs--about language, themselves, the world around them? In a strikingly original work intended not only for practicing lawyers but for anyone interested in the modern dilemma of the loss of meaning, Joseph Vining invites us to reconsider law as a unique form of thought, inseparably connected to everything in the world that makes up human identity. Oliver Wendell Holmes asserted at the end of the nineteenth century that human law is ultimately a phenomenon in quantitative relations to its causes and effects, and many have been left with an impression of law as a set of processes and rules. Vining takes issue with this and with various reductionist attempts in scientific thought today to express the universe in a single mathematical description of forces, as well as with post-structuralist speculation that there are no valid truth claims, and that human inter-action can be reduced to analysis of power relationships. Law, he argues, is an independent discourse, not reducible to any other, that exists only in human interaction and reflects continuing human worth. Vining's search to reinstate the spiritual dimension in public discourse brings him head-on with a wide array of powerful academic forces: linguistics theory, political science, the new historicism, and the traditional teaching of law. This book consists of a collection of what Vining calls "amplifications" of the implied text of the law--impressions, commentaries, vignettes, poems, and dialogues--which illustrate aspects of conventional legal language and logic, and the subjects legal practice regularly deals with, such as promises, death, and crime. Throughout we see that law reaches deeply into the way we know ourselves and other persons, all of whom speak through law as law connects language to person and person to action. The texts generated by legal method constitute the living record of social acquaintance and contest, speaking across cultures and across centuries. It is the close reading of legal texts and contexts, Vining argues, that provides the present source of the transcendental in modern secular life. But unlike the other academic arts of interpretation, law alone is directly connected with the most real, the most particular and, at the same time, the most universal facts of social life. From Newton's Sleep poses ultimate questions for a century that now approaches its end, casts doubt on certainties past and present, and creates new grounds for skepticism and conviction. The fragmentary form of the book mirrors its subject. It is intended to be picked up and read as occasion allows, especially at evening, by lawyers and all their fellow nonlawyers.

Product Description:

"Magill's Choice: U.S. Supreme Court" is an affordable, comprehensive and up-to-date survey of the history and functions of the Supreme Court. There are articles on all the justices, including those appointed by George W. Bush, articles on key constitutional issues, and more than 110 on landmark cases. "U.S. Supreme Court" is well organized and features clearly written articles. It offers the additional advantage of coming out at a time when the Supreme Court itself is undergoing important changes that need to be explained. Covered here are issues such as the Court responding to the aftermath of 9/11, the complications of the 2000 presidential election, U.S. involvement in Iraq, and the replacement of two justices, including the chief justice. "U.S. Supreme Court" also contains essays on types of law (such as administrative law, bankruptcy law, and state constitutions), individual pieces of legislation, and clauses and amendments to the U.S. Constitution. "U.S. Supreme Court" is alphabetically arranged. Each essay opens with selected ready-reference top matter that is most relevant to its category (such as birth and death dates for justices, along with details about their terms of service) and a statement of significance. Longer articles have updated bibliographies, and all articles have cross-references to other articles in the set. Emphasis throughout the set is on clear explanations of subjects, supported by illuminating graphics and illustrations. The 391 essays range in length from 250 to 3,000 words and contain several distinct component parts. All essays open with specially formatted top-matter sections, whose content varies according to essay type. The core of every essay is a clear discussion of its subject, whose relevance to the Supreme Court is constantly stressed. This is followed by alphabetically arranged cross-references to related articles. The top matter of the 110 essays on landmark cases is equally comprehensive. The Cases Appendix in volume 3 summarizes data on more than 590 major court cases, and additional references to cases - including hundreds of cases not covered in individual essays - can be found in the Court Case Index. A comprehensive Subject Index locates discussions of personages, concepts, laws, events, and other topics. Essay top matter is presented in a concise, ready-reference format that provides the most essential information at a glance. Top matter in each of the essays on individual justices, for example, opens with its subject's full name, brief identification, full birth and death information, date and president of appointment, and a summary statement of the justice's significance in Court history. Essay top matter also adds exact dates of the justices' Supreme Court service and identifies the presidents who appointed them. Product Description:
Impressive in its scope and inventiveness, DEMOCRACY BEYOND BORDERS stands at the forefront of a new generation of political thought which reassesses the philosophical foundations of the global order. Developing an innovative political theory of representation, the book provides compelling answers as to how we can ensure that global leaders act responsively and effectively in the interests of global citizens. It proposes practical reforms to the United Nations and other major institutions.

Synopsis Democracy Beyond Borders criticizes conventional theories of justice and democracy that focus almost exclusively on the state and its electoral cycles. Kuper shows how non-state actors, such as corporations and civil society advocates, can be brought into multi-level governance as partners with states. He presents an original theory of representation to answer the problem of accountability. At the core of this vision is a new separation of powers, in which different global actors check and balance one another in a complex harmony. This innovative framework complements electoral accountability and enables Kuper to recommend far-reaching reforms to the World Courts, the United Nations, and advocacy agencies including Transparency International.

Product Description:
An essential resource for students of social policy and social welfare as well as for social welfare practitioners and other human services professionals, this text examines the policymaking activity of the different branches of the American government and of the public-at-large as well as the interactions between the branches of government and the general public in the formation and implementation of social policy. In addition to examining the role of the legislative and executive branches of government, Theodore J. Stein covers the often-overlooked role of the judiciary in policymaking. He addresses the ways social welfare practitioners should interpret (1) conflicting judicial rulings in cases where courts of equal jurisdiction rule differently on the same matter and (2) judicial rulings that signal significant changes in the law. The book looks at politics, practice, and implementation and provides a historical background of social policy and social work practice plus a wealth of descriptive and analytic information concerning policymaking processes, specific social policies, and the effect of social policy on social programs.

Europe Undivided explores how the leverage of an enlarging EU has facilitated a convergence toward liberal democracy among credible future members of the EU in Central and Eastern Europe. It reveals how variations in domestic competition put democratizing states on different political trajectories after 1989, and illuminates the changing dynamics of the relationship between the EU and candidate states from 1989 to accession, and beyond. Albeit not by design, the most powerful and successful tool of EU foreign policy has turned out to be EU enlargement--and this book helps us to understand why, and how, it works.

But in Suspect Identities, Simon Cole reveals that the history of criminal identification is far murkier than we have been led to believe. Cole traces the modern system of fingerprint identification to the nineteenth-century bureaucratic state, and its desire to track and control increasingly mobile, diverse populations whose race or ethnicity made them suspect in the eyes of authorities. In an intriguing history that traverses the globe, taking us to India, Argentina, France, England, and the United States, Cole excavates the forgotten history of criminal identification--from photography to exotic anthropometric systems based on measuring body parts, from fingerprinting to DNA typing. He reveals how fingerprinting ultimately won the trust of the public and the law only after a long battle against rival identification systems.
As we rush headlong into the era of genetic identification, and as fingerprint errors are being exposed, this history uncovers the fascinating interplay of our elusive individuality, police and state power, and the quest for scientific certainty. Suspect Identities offers a necessary corrective to blind faith in the infallibility of technology, and a compelling look at its role in defining each of us.
