Religion and Personal Law in Secular India: A Call to Judgment
By Gerald James Larson
————————————————————————————————————————————
Publisher:Indiana University Press
Number Of Pages:328
Publication Date:2002-01-01
ISBN-10 / ASIN:0253339901
ISBN-13 / EAN:9780253339904
————————————————————————————————————————————
Product Description:
Though mandated by the constitution, a uniform civil code of law has never been written or instituted in India. As a result, in matters of personal law-the segment of law which concerns marriage, dowry, divorce, parentage, legitimacy, wills, and inheritance-individuals of different religious backgrounds must appeal to their respective religious laws for guidance or rulings. But balancing the claims of religious communities with those of a modern secular state has caused some intractable problems for India as a nation. Religion and Personal Law in Secular India provides a comprehensive look into the issues and challenges that India faces as it tries to put a uniform civil code into practice. Themes such as the extent and jurisdiction of civil laws, the relationship between religious law and a system of personal law, the desirability of a uniform civil code, the treatment of women and minorities under a single law, and the maintenance of religious pluralism in India, are explored in 16 thought-provoking essays. Scholars representing a wide range of disciplines, from both North America and India, provide a unique comparative perspective on complex issues of multiculturalism that characterise Indian society and identities. Readers seeking deeper understandings of Indian history and culture will find a sensitive handling of the tensions between religious law and the claims of a modern, secular state in this timely volume. Contributors include Granville Austin, Robert D. Baird, Srimati Basu, Kevin Brown, Paul Courtright, Rajeev Dhavan, Marc Galanter, Namita Goswami, Laura Dudley Jenkins, Jayanth Krishnan, Gerald James Larson, John H. Mansfield, Ruma Pal, Kunal M. Parker, William D. Popkin, Lloyd I. Rudolph, Susanne Hoeber Rudolph, Sylvia Vatuk, and Arvind Verma.

Lawyers and Immigrants, 1870-1940: A Cultural History
By Louis Anthes
————————————————————————————————————————————
Publisher:LFB Scholarly Publishing
Number Of Pages:318
Publication Date:2003-09
ISBN-10 / ASIN:1593320108
ISBN-13 / EAN:9781593320102
————————————————————————————————————————————
Product Description:
Anthes tells the story of European immigrants and their relationship to New York's legal profession between Reconstruction and the Great Depression. Using published materials, archival sources, and privately maintained documents, he explores how immigrants – mainly from southern and eastern Europe – passed through Ellis Island, used the law after suffering personal injuries at work and at home, and studied at city law schools. They improvised their own legal descriptions of everyday life by relying on themselves, families, neighbors, and local lawyers. At the same time though, New York's more established lawyers persistently interpreted immigrants' legal strategies as inconsistent with their profession's highest duties, and they promoted many reforms to maintain their control over the practice of law.

Champion of Civil Rights: Judge John Minor Wisdom (Southern Biography Series)
By Joel William Friedman
————————————————————————————————————————————
Publisher:Louisiana State University Press
Number Of Pages:401
Publication Date:2009-01
ISBN-10 / ASIN:0807133841
ISBN-13 / EAN:9780807133842
————————————————————————————————————————————
Product Description:
One of the least publicly recognized heroes of the civil rights movement in the United States, John Minor Wisdom served as a member of the U.S. Court of Appeals for the Fifth Circuit from 1957 until his death in 1999 and wrote many of the landmark decisions instrumental in desegregating the American South. In this revealing biography, law professor Joel William Friedman explores Judge Wisdom's substantial legal contributions and political work at a critical time in the history of the South.
In 1957, President Eisenhower appointed Wisdom to the Fifth Circuit, which included some of the most deeply segregated southern states: Alabama, Florida, Georgia, Louisiana, Mississippi, and Texas. In the tumultuous two decades following its decision in Brown v. Board of Education, the Supreme Court issued only a few civil rights decisions, preferring instead to affirm Fifth Circuit Court opinions or let them stand without hearing an appeal. Judge Wisdom, therefore, authored many of the decisions that transformed the South and broke down barriers of all kinds for African Americans, including the desegregation of public schools.
In preparing this first full-length biography of Judge Wisdom, Friedman had unrestricted access to Wisdom's voluminous repository of personal and professional papers. In addition, he draws on personal interviews with law clerks who served under Judge Wisdom, resulting in a unique, behind-the-scenes account of some of the nation's most important legal decisions: the admission of the first black student to the University of Mississippi, the initiation of contempt proceedings against Mississippi Governor Ross Barnett, and the destruction of obstacles that had previously kept black Americans from voting. Friedman also explores Wisdom's political life prior to joining the federal bench, including his pivotal role in resurrecting the Louisiana Republican Party and in securing the Republican presidential nomination for Eisenhower.
A compelling account of how a child of privilege from one of America's most socially and racially stratified cities came to serve as the driving force behind the legal effort to end segregation, Champion of Civil Rights offers judicial biography at its best.

Publication Date:1991-04-11
ISBN-10 / ASIN:0520073371

————————————————————————————————————————————
Product Description:
Law and the Order of Culture is an outstanding collection of essays that explores the cultural creation of legal meaning, addressing interpretive processes within the law as well as the social constitution of legal doctrine. Originally published in Representations, these essays are at the center of the "law and literature" movement which exemplifies a burgeoning literature in feminist jurisprudence, critical legal studies, and other work that has focused on law as evidence of cultural orderings. For this edition Robert Post has written a new introduction, proposing an analytic framework for this literature and discussion of the seven essays contained within the book.
Ranging over a variety of interdisciplinary perspectives, the contributors to the volume address such central issues as the construction of legal normativity, interpretive theory and practice in constitutional law, the function of legal metaphors, the interpretive foundations of the law/fact distinction, and the role of politics in contemporary critical legal studies. Law and the Order of Culture will attract a broad and eclectic readership across many disciplines.

Freedom Under Siege: The U.S. Constitution After 200 Years

Publisher:Ludwig von Mises Institute
Number Of Pages:
Publication Date:2007
ISBN-10 / ASIN:B000XG4ZGQ
ISBN-13 / EAN:
————————————————————————————————————————————
Product Description:
Here is Ron Paul's political manifesto, a courageous book on civil liberties and the rights of Americans that are relentlessly under assault from government. It was written in 1987, on the 200th anniversary of the Constitution, and is back in print for the first time. It is here that Dr. Paul provides his most extended thoughts on what it means to be a constitutionalist in the tradition of Thomas Jefferson. He connects violations of individual rights to an interventionist foreign policy and the supposed needs of national security. Here he blasts the draft and draft registration, impositions on the right of individuals to own guns, restrictions on the freedom to speak and write, and draws out the links between all these policies. Paul further discusses the tie between individual liberties and sound money. When a nation's money is controlled by the people instead of the state, they retain their essential freedoms. But when money is monopolized by government with no tie to a commodity, the state is in a position to ride roughshod over our liberties. Other issues discussed include the true meaning of patriotism, the moral law as it applies to politics, the meaning of leadership in a free society, the nature of the state in light of his experiences in Washington, and the historic and ever-lasting conflict between the individual and the state. 174 pages, 6" x 9", paperback

Representing Justice : Stories of Law and Literature[ Audio Book ]

————————————————————————————————————————————
Publisher:The Teaching Company
Number Of Pages:
Publication Date:2006
ISBN-10 / ASIN:B001H7GE3C
ISBN-13 / EAN:
————————————————————————————————————————————
Product Description:
Professor Susan Sage Heinzelman, who has been honored many times for her teaching skills, is also president of the Association for the Study of Law, Culture, and the Humanities, and she brings to these lectures many years of thought and research into the roles of law and literature in society and culture and their relationship to one another. She is especially concerned to break down the stereotypical definitions of these two disciplines: that literature is fictive and subjective, that is, persuasive on a primarily emotional level understood as the realm of the feminine, and that law is factual and objective, and thus primarily persuasive in the intellectual realm traditionally ascribed to the masculine. Professor Heinzelman refers to the representation of culture, whether legal or literary, through language, image, symbol systems, and action. It is the intertwining of the stereotypical definitions that she untangles in these lectures, showing how each has contributed to creating our cultural beliefs and expectations "in similar waysby offering us ways of imagining ourselvesboth at our best and at our worst." Professor Heinzelman's examination encompasses more than 3,000 years. It begins with the Old Testamentin which literature was lawand takes us through ancient Greece, the Middle Ages, England's experience of the Renaissance and the Enlightenment, and the 19th and 20th centuries. Focusing on works of literature that hold law, implicit or explicit, as a central themeas well as on the overall relationship between law and literature in societyshe shows how that relationship gradually transformed from the astoundingly intricate cross-connections between law and literature still present during the time of Shakespeare, to a point in the mid-18th century when the two disciplines separated more clearly into the distinct realms we recognize today.

Immigration And Criminal Law in the European Union (Immigration and Asylum Law and Policy in Europe)
By Paul Minderhoud (Editor) Elspeth Guild (Editor)
————————————————————————————————————————————
Publisher:Brill Academic Publishers
Number Of Pages:424
Publication Date:2006-06-01
ISBN-10 / ASIN:9004150641
ISBN-13 / EAN:9789004150645
————————————————————————————————————————————
Product Description:
This is a study of the legal framework on criminal measures on trafficking and/or smuggling and facilitating illegal entry in six Member States: France, Germany, Italy, the Netherlands, Spain and the UK, and the European Union. This issue is at the nexus of migration and criminal law. The system of criminal law in the Member States is a central part of the balance of the powers of the authorities and the rights of the citizen. The way in which civil liberties of the individual are weighed in comparison with public protection duties by the authorities is in essence a constitutional issue. The treatment of foreigners, in particular as regards their entry onto the territory and residence is not part of the constitutional settlements, but a field governed by state discretion and exceptionalism. The rules and administrative measures regarding entry, residence and expulsion of foreigners is not subject to the same civil liberties guarantees of due process as apply in criminal law.
This comparative study examines how, in each Member State, the insertion of immigration into criminal law takes place. Do the rules of criminal law in respect of due process take precedence over the lower evidential and procedural requirements which are applied in the field of immigration? How does the criminal justice system deal with this new field where central constitutional issues are not present? There are two levels on which the insertion of immigration into criminal law takes place – the legal and the social. This book deals with both. On the one hand it looks at the laws and the court decisions on criminal trials in respect of immigrants for immigration related offences, on the other hand it looks at how the society (political actors, media, interest groups etc) discuss and develop this issue.
This book is designed for policymakers, academics, students and activists concerned about the European Union.

Copyrights and Copywrongs: The Rise of Intellectual Property and How It Threatens Creativity (Fast Track Books)
By Siva Vaidhyanathan
————————————————————————————————————————————
Publisher:NYU Press
Number Of Pages:243
Publication Date:2001-08-01
ISBN-10 / ASIN:0814788068
ISBN-13 / EAN:9780814788066
————————————————————————————————————————————
Product Description:
"It has taken lawyers 200-plus years to morph copyright law from the balanced compromise that our framers struck to the extraordinary system of control that it has become. In this beautifully written book, a nonlawyer has uncovered much of the damage done. Copyrights and Copywrongs is a rich and compelling account of the bending of American copyright law, and a promise of the balance that we could once again make the law become." -Lawrence Lessig, Stanford Law School and author of Code and Other Laws of Cyberspace
"Siva Vaidhyanathan has done a big favor for the academic and library communities. In this book, he has spelled out in clear, understandable language what's at stake in the battles over the nation's intellectual property. The issues brought forward are critical to the future of scholarship and creativity. Librarians and academics are wise to purchase this book and add it to their 'must read' lists." -Nancy Kranich, President, American Library Association, 2000-2001
"Copyrights and Copywrongs is an urgent information-age wake-up call to a public cocooned in belief that 'copyright' is a seal and safeguard for consumers and producers of culture-ware. This book guides us into the legal labyrinth of a new world of so-called intellectual property, in which 'fair use' isn't fair, where rights are waived and free speech-when we can get it-costs a great deal of money. From print books to video games, Copyrights and Copywrongs shows free expression in a legalistic chokehold. Clearly written, meticulously argued, this book is a must." -Cecelia Tichi, author of Embodiment of a Nation: Human Form in American Spaces
Copyright reflects far more than economic interests. Embedded within conflicts over royalties and infringement are cultural values-about race, class, access, ownership, free speech, and democracy-which influence how rights are determined and enforced. Questions of legitimacy-of what constitutes "intellectual property" or "fair use," and of how to locate a precise moment of cultural creation-have become enormously complicated in recent years, as advances in technology have exponentially increased the speed of cultural reproduction and dissemination.
In Copyrights and Copywrongs, Siva Vaidhyanathan tracks the history of American copyright law through the 20th century, from Mark Twain's vehement exhortations for "thick" copyright protection, to recent lawsuits regarding sampling in rap music and the "digital moment," exemplified by the rise of Napster and MP3 technology. He argues persuasively that in its current punitive, highly restrictive form, American copyright law hinders cultural production, thereby contributing to the poverty of civic culture.
